Bangladesh Ban Plea Rejected: Major High Court Ruling
High Court Ruling on Bangladesh Ban Plea

In a Major development, the Delhi High Court has officially dismissed a Public Interest Litigation (PIL) that sought a Bangladesh Ban from international cricket. The petition, which cited concerns over communal violence, was deemed non-maintainable by a Division Bench. The court emphasized that a Bangladesh Ban falls under the executive domain of foreign policy rather than judicial intervention. This Cricket Ban request was viewed as an overreach of the court's jurisdiction.

Judicial Jurisdictional Limits

Chief Justice Devendra Kumar Upadhyaya noted that a Bangladesh Ban cannot be enforced by Indian courts against foreign entities like the ICC or BCB. Under Article 226, the court lacks the power to issue a Cricket Ban against sovereign nations. The petitioner’s reliance on foreign jurisprudence was also rejected, as the Legal Setback highlighted the flaws in the petition’s logic. The Bench warned that seeking a Bangladesh Ban without legal standing wastes precious judicial resources.

Diplomatic and Policy Matters

Solicitor General Tushar Mehta, representing the BCCI, argued that a Bangladesh Ban involves complex international relations. The court agreed, stating that a Cricket Ban is a matter for the government to decide, not law students or litigants. To avoid heavy costs, the petitioner withdrew the plea for a Bangladesh Ban. This decision reinforces that a Cricket Ban or any Bangladesh Ban remains a diplomatic issue, ending the Legal Setback for the sport's administration.
